Each of the instant public prosecutions is dismissed.
1. On November 17, 2014, the Defendant: (a) around 12:35, the construction site managed by the victim D (32 years of age) located in Seo-gu Incheon, Seo-gu, Incheon, demanded the payment of unpaid wages to the victim; (b) the Defendant asserted the payment of unpaid wages to the victim; and (c) assaulted the victim’s neck three times by hand; and (d) continued to comply with the victim’s neck, E, etc., who is the human father of the said construction site, and insulting the victim by openly insulting the victim.
2. Determination
(a) Crimes of non-violation of will and offense subject to prosecution on complaint: Articles 260 (3) and 312 (1) of the Criminal Act;
B. On June 11, 2015, after the prosecution of this case, statement that the victim does not want to punish the defendant during the examination of witness.
