1. The Defendant’s KRW 130,154,00 for the Plaintiff and KRW 5% per annum from July 4, 201 to February 13, 2017.
On May 10, 2007, the Plaintiff acquired the claim of KRW 67,200,00 from C to the Defendant, and the Defendant, on April 3, 201, prepared a loan certificate of KRW 62,954,00, and agreed to pay the Plaintiff KRW 130,154,00 in total (= KRW 67,200,00) within three months, with the Plaintiff’s agreement to pay KRW 62,954,00,00 in total (= KRW 67,200,00). It is without dispute between the parties or recognized by the statement in subparagraphs 1 through 3.
According to the above facts of recognition, the defendant is obligated to pay to the plaintiff 130,154,00 won and damages for delay at the rate of 5% per annum as prescribed by the Civil Act from July 4, 2011 to February 13, 2017 when a copy of the complaint of this case was served on the defendant from July 4, 2011, and 155 per annum as prescribed by the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the next day to the day of full payment.
Therefore, the plaintiff's claim of this case shall be accepted for all reasons and it is so decided as per Disposition.
