1. The defendant A shall be punished by imprisonment with prison labor for ten months and by imprisonment with prison labor for ten months;
2.Provided, That this judgment has become final and conclusive.
Punishment of the crime
Defendant
On June 15, 2017, A was sentenced to imprisonment with prison labor for 10 months with prison labor for fraud in the Incheon District Court Branch Branch of the Incheon District Court, and the above judgment became final and conclusive on April 7, 2018.
Defendant
B On June 21, 2017, the District Court sentenced two years of imprisonment for fraud at the District Court, which became final and conclusive on January 26, 2018.
The Defendants conspired to register Defendant B as a director of the above company by forging D’s power of attorney, a shareholder of C, etc.
1. On January 16, 2017, the Defendants forged private documents: (a) output the power of attorney to delegate the authority to commission the authentication of a deed signed by a private person using a computer for the purpose of uttering at the office of Defendant E located in Seocho-gu Seoul, Seocho-gu; and (b) Defendant A stated “A, Gyeonggi-do Seocheon-gu, Seocheon-gu, Seocheon-gu, Incheon;” (c) indicated “D, Gwangjin-gu, Seoul, and H” in the delegating column, and then affixed the said D’s seal voluntarily produced on their name.
Accordingly, the Defendants forged a letter of delegation in the name of a private document D, which is a private document on rights and obligations for the purpose of uttering in collusion.
2. On January 23, 2017, Defendant B held the forged power of representation and extraordinary shareholders’ meeting minutes, list of shareholders, certificate of personal seal impression, etc. on the same day with Defendant A, and Defendant A, a notary public located in the third floor of Seocho-gu Seoul International Building, applied for a notarized act at the J office of the law firm, thereby exercising the forged private document by submitting the said power of representation to the attorney-at-law who is aware of the forgery at the J office.
3. On January 23, 2017, the Defendants entered false information, such as public electromagnetic records, etc., have public officials complete registration for change of their corporate register with respect to public officials, who had registered false information, appointed Defendant B, etc. as a director in-house of C around January 16, 2017 at the office of governmental registry of the District Government District Court located in 146 Doo-ro 13, Kui-ro Doo-ro.
