A. Comprehensively taking account of the overall purport of the pleadings in the statement No. 1, the Plaintiff prepared a letter of commitment that “Defendant B shall repay KRW 270 million to the Plaintiff up to July 30, 2017, and Defendant C’s said obligation shall be jointly and severally guaranteed by Defendant C” (hereinafter “instant letter of commitment”) between the Defendants and the Defendants around June 2017.

B. The Defendants raised an objection on April 19, 2018 against the payment order dated April 5, 2018 in this Court ordering the payment of the principal amount of KRW 270 million and delay damages.

Defendant C was present on the date of conciliation on August 13, 2018, and Defendant B did not appear and failed to make conciliation, and the court rendered a decision in lieu of conciliation to pay KRW 216,50,000 to the court. However, the Defendants raised an objection.

The Defendants paid KRW 113,500,000 from June 5, 2017 to May 9, 2018 as follows, and submitted a preparatory document to the effect that the remaining KRW 156,500,000 has not been paid up until now.

C. The Plaintiffs submitted an application for mediation decision as of September 19, 2018, and submitted a written agreement on September 12, 2018, stating that “The Plaintiff and the Defendants jointly and severally pay KRW 186,50,000,000, and shall be paid in installments each month from September 28, 2018 to five million, and even once, the Plaintiffs shall lose the benefit of the time and make payment in addition to 15% interest per annum.”

On November 1, 2018, the Defendants filed an objection again to the same effect as the agreement written in the paragraph.

Defendant C was present at the preparatory date for pleading on December 18, 2018, and Defendant C was not present at the preparatory date for pleading, and Defendant C was above C.

The court confirmed the purport of the written agreement.

E. The court held as of December 18, 2018 to again provide KRW 186,50,000.
