A defendant shall be punished by imprisonment for four months.

Reasons

Punishment of the crime

On February 17, 2016, the Defendant was sentenced to imprisonment with prison labor for computers and other use of computers at the Jeonju District Court on February 17, 2016 and continues the appellate trial.

The Defendant posted a letter on the bulletin board of “Ickn,” which is an online game brokerage site, to the effect that “I would sell a monthly nuclear program,” which is an illegal franchising program capable of seeing the enemy’s location from among the online games,” and then was the most true fact that I would like to conclude that I would sell a “monthly nuclear program” program with the above function to the victims who reported it, and that I would like to transmit a “mail” file as seen below.

The “stamp file” file (organization of management file files and skyworld.ex) is a program that has a remote control and key function (the function of storing and transmitting the input value divided through user’s keyboard as a file), and the damaged person performed the said file and connected the said item’s website, and was a program that can be identified as a computer for the Defendant’s use, such as the ID and password of the unit unit that the victim entered.

1. Crimes against the victim BU;

(a) No person who violates the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc. (Violation of Information and Communications Network, etc.) shall destroy, destroy, alter, or forge an information and communications system, data, program, etc., or distribute or spread a program that may interfere with the operation thereof (hereinafter “malicious program”) without a justifiable ground;

Nevertheless, around 05:40 on March 5, 2013, the Defendant posted a notice to the effect that he sells a monthly nuclear program, which is an online game “satis,” which is an illegal cat program, on the bulletin board of the “Acatis,” and then, the Defendant was a malicious program using the Defendant’s Internet website to the victim BU who reported and contacted it.
