The defendant shall be innocent.

Reasons

1. On November 20, 1994, at around 23:41 on November 20, 1994, the penal provisions applied to a summary order subject to review on November 20, 1994, by the employees of the defendant, lose its retroactive effect according to the Constitutional Court’s decision of unconstitutionality, and thus, the defendant is acquitted pursuant to the former part of Article 325
