A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Punishment of the crime
The Defendant, even though he did not take food at a restaurant, such as a large retailer, a frequency, etc., and asked a company selected as a small-scale discount store, etc. to take food and drink or have been infected with food poisoning in a large retailer, etc. through Internet search, etc., and demanded compensation. In the absence of such request, the Defendant, upon posting on the Internet or reporting to consumer protection center, received money for medical expenses by placing a heavy amount of money on the Internet, and received money from the credit card company’s employees as if they were to file a civil petition with the Financial Supervisory Service by using the Defendant’s information about delayed payment of the Defendant’s card to the Defendant’s wife without the Defendant’s consent, and received money for the purpose of mobile phone repair, loan, etc.
Accordingly, around April 1, 2016, the Defendant: (a) posted a phone call to the victim C (35 years of age) who is an employee of the department store at the port store in the Defendant’s residence located in the north-gu building 104 603 Dong-gu, Mapo-si; and (b) received money from the victims, “I will withdraw money from other measures if I would like to give prompt treatment, because I would like to know of it as soon as possible; and (c) received 50,000 won from the victims of drinking alcohol to the Defendant’s Nonghyup Bank account (D) account at around 11:17 of the same day, including the transfer of money from February 2, 2016 to April 24, 2016, the Defendant received KRW 50,610,710 won in total from the victims to October 10, 2016 to the Defendant’s account (D).
