1. The defendant shall pay to the plaintiff KRW 206,810,498 and KRW 119,00,00 among them, from February 29, 2012 to the day of full payment.
The Plaintiff: (a) determined the interest rate of March 19, 2010 as 7.92% per annum (19% per annum); (b) determined the interest rate of April 16, 2010 as 9.63% per annum (19% per annum); (c) determined the interest rate of April 16, 201 as 8.32% per annum (19% per annum); (d) determined the interest rate of September 1, 201 as 18.32% per annum; (e) determined the interest rate of 19.58% per annum (19% per annum); and (e) loaned the amount of interest for arrears of KRW 20 million per annum 9.58% per annum; and (v) determined the amount of interest for arrears of KRW 100,000 per annum (25% per annum); and (v) determined the amount of interest for arrears of KRW 198,000,000 per annum from the Plaintiff; and (v) determined the amount of interest for arrears of KRW 1819,258.
Therefore, the defendant is obligated to pay to the plaintiff the total sum of the above amounts of KRW 206,810,498 and the above amount of KRW 119,738,100 among the loan obligations (= KRW 40,738,100, KRW 79 million) with the interest rate of KRW 119,000,000, which is the interest rate of delay damages from February 29, 2012 to the date of full payment, and KRW 19,000,000, which is the interest rate of delay damages from February 29, 2012, and KRW 20,061,880, which is the interest rate of delay damages from February 29, 2012 to the date of full payment. Thus, the plaintiff's claim for delay damages is justified and it is so decided as per Disposition.
