A. On August 9, 2005, the Plaintiff loaned KRW 50 million to the Defendant at the end of October 2005, with the maturity of payment fixed on October 9, 2005.

B. Therefore, the Defendant is obligated to pay to the Plaintiff the remainder of KRW 45 million after deducting the amount of KRW 5 million paid by the Plaintiff from the foregoing borrowed amount, and to pay damages for delay calculated at the rate of 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from February 23, 2016 to the day of complete payment, which is the day following the delivery of a copy of the application for the instant payment order.

2. Articles 208(3)1 and 257(1) of the Civil Procedure Act, which hold a judgment without holding any pleadings.
