A. A. On July 3, 2009, the Defendant submitted a claim for the management expenses of a vessel at the 30 office of the Incheon District Court auction in Nam-dong, Incheon Metropolitan City around July 3, 2009, “24,640,000 won (2.1 million won for two seafarers of each month, 1.5 million won for two expenses, 50,000 won for a management company fee, 2.80,000,000 won for a management company fee, 3,080,000 x 8 = 24,640,000,000 won for the management expenses of the vessel at the 30 office of the Incheon District Court located in Nam-dong, Incheon Metropolitan City (hereinafter referred to as the “Seoul District Court”) from November 5, 2008 to July 26, 2009.” The Defendant received the aforementioned management expenses of the vessel from an employee under the name of the victim on August 26, 2009.

However, in fact, from November 5, 2008 to July 2, 2009, only one seafarer was a seafarer from the above D and E, and there was no other seafarer's work, and therefore, the part on 9.2 million won (one seafarer's salary for eight months, 900,000 won, and 1.50,000 won per month) was a false claim.

In this way, the defendant received the property of the victim by deceiving the victim.

B. On November 11, 2010, the Defendant submitted a claim for the management expenses of a vessel at an auction office of the Incheon District Court of Incheon around November 201, 201 to KRW 70,686,00 (two seafarers of April 23, 200, KRW 900,000, KRW 1500,000 for each of the two seafarers of each month, KRW 210,000,00 for the management company fee, KRW 210,310,00 for each of the management company fee, KRW 69,30,000,000 for the management expenses of the vessel at around 30-1, 200 at the above Incheon District Court’s auction office ( KRW 1,386,00 for the above victim’s name) and received payment of the management expenses of the vessel from the employees under the name of the victim on December 8, 2010.

However, in the above G, a seafarer H worked in April through May 2008, and from May 2008 to October 2008, only a seafarer F was employed from November 2008, and there was no person working as a seafarer from November 2008 to November 9, 2010. Thus, from June 2008 to October 2008, 5.250,000 won (one seafarer’s salary, 90,000 won per month, and 1.50,000 won per week), and November 2008. < Amended by Presidential Decree No. 21130, Nov. 1, 2008>
