The prosecutor's appeal is dismissed.
Reasons
1. The judgment of the court below which acquitted the Defendant on the ground of the summary of the grounds for appeal (misunderstanding of the facts) based on the evidence submitted by the prosecutor is erroneous in the misapprehension of facts.
2. When examining the reasoning of the judgment of the court below closely with the records of this case, the judgment of the court below is fully acceptable, and the prosecutor's allegation of mistake is without merit.
3. The appeal by the prosecutor of the conclusion is dismissed on the ground of appeal.
