1. The Defendant shall pay to the Plaintiff KRW 45,00,000 and the interest rate of KRW 15% per annum from November 29, 2018 to the day of full payment.
The fact that the Plaintiff lent KRW 50,000,000 to the Defendant from July 14, 2017 to July 31, 2017 (no evidence exists to deem that the Plaintiff agreed on the repayment period separately) that there was no dispute between the parties.
Therefore, the Defendant is obligated to pay the Plaintiff the remainder of KRW 45,00,000,000, excluding the remainder of KRW 5,000,000,000, out of the above borrowed money, and the damages for delay calculated at the rate of 15% per annum from November 29, 2018 to the date of full payment, which is the day following the delivery of a copy of the instant complaint.
Although the defendant alleged that the plaintiff paid the above KRW 7,200,000 to the above KRW 5,000,000 in addition to the above KRW 5,00,000, it is insufficient to recognize the above only by the descriptions of subparagraphs 1-1 and 2-2. There is no other evidence
The plaintiff's claim shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
