1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
1. Determination as to the cause of claim
A. 1) The Plaintiff is the Korea Land Trust Co., Ltd. (hereinafter “Korea Land Trust”) on September 16, 2014.
From the point of view, the apartment 46 bonds on the ground (hereinafter referred to as “instant real estate”) on the non-party B, Gangwon-do fleet-gun.
2) The sales contract to purchase the purchase price at KRW 3,154,470,00 (hereinafter “instant sales contract”) is deemed to have been concluded.
The Plaintiff entered into a contract. On September 2014, the Plaintiff entrusted the Defendant with the registration of ownership transfer of the instant real estate. (2) However, the instant real estate was completed in the registration of provisional disposition prohibiting disposal of real estate in the name of the LAC, the LAC, the LAC, the LAC, the LAC, the LAC, and D (hereinafter “each provisional disposition of this case”) respectively, and there was a person who asserts a lien, and the lawsuit for ownership transfer registration was pending.
3) Around August 4, 2014, the Plaintiff entered into a statement of performance with the purport that E and E are responsible for the cancellation of the registration of each of the instant provisional dispositions and actively cooperate with each of the instant provisional dispositions, and agreed on a certain amount of agreement. Accordingly, on August 4, 2014, the Plaintiff paid KRW 20,000 won to F, who is related to D, and KRW 10,000,000,000 to E, and on August 5, 2014, paid KRW 10,000 and KRW 20,000,000 to G, who is the related parties to the Gold P&D industry, and on August 25, 2014, the Plaintiff newly paid KRW 50,000,000 to the creditor of the instant provisional disposition with respect to some number of units of the instant real estate in the name of the Plaintiff (hereinafter referred to as the “Provisional Disposition 14,2014”).
5) The Plaintiff is the purchaser of each unit of the instant real estate, including H, I, and J (hereinafter “H”)
In order to sell the balance to the purchaser and pay the balance with the purchase price.
Some of the above buyers shall be the number of units of the instant real estate purchased respectively.
