The defendant shall pay to the plaintiff KRW 101,796,466 as well as KRW 101,385,516 from April 28, 2020 to May 31, 2020.
In full view of the overall purport of the pleadings in the evidence Nos. 1 through 5, it is recognized as the same facts as the entry of the cause of the claim in the attached sheet.
Therefore, the Defendant is obligated to pay to the Plaintiff 101,796,466 won (=10,950 won additional guarantee fees of KRW 101,385,516) and damages for delay calculated at each rate of 12% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, from April 28, 2020 to May 31, 2020, which is the date following the date of subrogation repayment, to the Plaintiff, 10% per annum, which is the rate of damages for delay of agreement from April 28, 2020 to May 31, 2020, which is apparent from the following day to October 25, 2020, which is the date of delivery of the copy of the complaint of this case, 8% per annum of the changed rate of damages for delay of agreement from the next day to the date of full payment.
Therefore, the plaintiff's claim is reasonable, and it is so decided as per Disposition.
