A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The defendant of "2016 Highest 673" is an employer who is a person in charge of the operation of a vessel processing business with the trade name of 200 full-time workers of E, a stock company, etc.
1. The Defendant in violation of the Labor Standards Act did not pay 30,932,536 won, including 626,00 won, from April 1, 2014 to May 23, 2015, as well as 2 through 6, 9 through 13, 16, 18, 20 through 22, 24, 26, 28 through 30, 32, 33, 35, and 37, total sum of 24 workers, as well as 30,932,536 won, within 14 days from each retirement date without an agreement between the parties on the extension of the payment date.
2. The Defendant violated the Act on the Guarantee of Retirement Benefits for Workers did not pay KRW 4,251,950,00,000,000,000,000,000,000,000 from April 1, 2014 to May 23, 2015, as stated in attached Table 1, as well as KRW 2,3,5 through 9,11, 13, 16, 18, 20, 22, 26, 28, 29, 32, 35, and 37, in total, KRW 5,048,046,00,00,000,000,000,000,000,000,000,000,000,000,000,00
The Defendant, “2016 Highest 1958,” as the representative director of D (State) E, who is a subcontractor in the city from around 2014 to September 2015, was in charge of the operation of the said company, and was engaged in the business of paying the national pension contributions, health insurance contributions, and employment insurance premiums, after deducting the national pension contributions, the national pension contributions, the health insurance, and the insurance premiums from the wages of the employees of the said company.
The Defendant: (a) around April 10, 2015; (b) around May 10, 2015; (c) around March 10, 2015; and (d) around March 3, 2015, from the national health insurance premium, KRW 15,735,860 in the name of the health insurance premium; (d) KRW 4,736,090 in the name of the employment insurance premium; (e) KRW 14,86,310 in the name of the national pension premium; (e) KRW 24,584,690 in the name of the insurance premium; (e) KRW 4,563,260 in the name of the insurance premium; and (e) KRW 13,707,310 in the name of the national pension premium; and (e) May wage.
