A. The Plaintiff’s status 1) The Plaintiff was the grandchildren of the deceased H (the deceased on February 23, 1921, and I succeeded to Australia) and the children of the deceased I (the deceased on September 14, 1943, and the Plaintiff’s succession to Australia) who were returned to the Republic of Korea during the Korean War. (2) On July 3, 1972, J, the spouse of the Plaintiff, reported that the Plaintiff died on July 15, 1961.

Since then, the plaintiff Eul et al. filed an application for correction of the family relation register with the Daejeon Family Court No. 2016No. 82 on the ground that the plaintiff's death report against the plaintiff around 2016 was false.

3) On September 8, 2016, the Seoul Family Court decided to appoint B as an administrator of the Plaintiff, who is an absentee (hereinafter “Seoul Family Court”) (see, e.g., Supreme Court Decision 2016 Ma6569). B) On April 1, 1913, H was under the circumstances of the 443 square meters (hereinafter “K land”).

2) On January 24, 1980, L completed registration of ownership preservation on K’s land in accordance with the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 3094). 3) On October 12, 2007, L was merged with the Chungcheong M& 94 square meters on the land.

4) On November 17, 2016, Defendant C completed the registration of ownership transfer on the land listed in the annexed Table 1, which was combined as above, based on donation on November 15, 2016. C. H was assessed on April 1, 1913 (hereinafter “N land”).

2) L filed a lawsuit against H on May 10, 1965 against Cheongju District Court, Young-dong Branch, 1968Ga249 against N land, and the above court rendered a judgment that accepted L’s claim on December 30, 1968. L’s registration of ownership transfer was completed in H’s name on March 15, 1973 on the same day by subrogation of H, and on the same day, the registration of ownership transfer was completed on May 10, 1965.

4 Defendant D and E shall register the transfer of ownership based on sale on June 28, 2016 with respect to 1/2 shares among N land on August 22, 2016.
