The prosecutor's appeal is dismissed.
1. According to the reasoning of the appeal, the victim, D, and E’s reliable statement, the Defendant told the victim on January 22, 2016 that “the victim shall die in this year,” and recognized the fact of threatening the victim by acting as candlelights.
2. The following circumstances acknowledged by the court below and the evidence duly adopted and examined by the court below's decision, namely, (i) the victim's children were the victim; (ii) the victim filed a complaint with the defendant and most of the victims were suspected or dismissed; and (ii) the court below stated that "the defendant tried to harm the victim by using candlelight in front of his/her portrait photograph; (iii) the F prevented the defendant; and (iv) the mother of the court below stated that "the mother of the defendant did not know that he/she would have taken the victim at H funeral ceremony," and that "the mother of the court below did not know that he/she would have taken the victim at the time of his/her funeral ceremony, and attempted to be acquitted of the victim's credibility and injury on the ground that he/she could not have known that he/she would not have taken the victim's funeral hall at the time of his/her temporary appearance or injury."
