A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.
Punishment of the crime
"2018 Highest 2537"
1. Around July 16, 2018, the Defendant committed a crime on July 16, 2018: (a) around 14:30 on July 16, 2018, in a “D” restaurant managed by the victim C of the first floor underground of the Songpa-gu Seoul building B, Songpa-gu, Seoul; (b) as if he were to pay the price despite having no intent or ability to pay the price despite being provided with food, he/she was provided with food equivalent to the total amount of KRW 56,80,00 in the market price from the damaged person
2. On July 20, 2018, the Defendant: (a) around 18:00 on July 20, 2018, committed a crime in a “G” restaurant managed by the Victim F of the 6th floor of Songpa-gu Seoul building Songpa-gu, Songpa-gu, Seoul; (b) as if he were to pay the price despite having no intent or ability to pay the price despite being supplied with food; and (c) was provided with food equivalent to KRW 110,000,000 in total, and acquired it by deception.
3. On July 27, 2018, the Defendant committed the crime at around 15:40 on July 27, 2018, committed a crime in the “I” restaurant working for the victim H on the fourth floor of Songpa-gu Seoul building B, Songpa-gu, Seoul, as if he were to pay the price despite having no intent or ability to pay the price even if he/she was provided with food, and he/she was provided with food equivalent to KRW 111,90,00 in total from the damaged person and acquired it by deception.
4. On July 28, 2018, the Defendant committed the crime in the “K” restaurant managed by the victim J on the fifth floor of the Songpa-gu Seoul building B, Songpa-gu, Seoul around July 28, 2018, was provided with food and drinked by the Defendant after being provided food and drinking the amount of the completion despite having no intent or ability to pay the amount of the completion despite being provided with food and drink.
5. The Defendant committed the crime of July 31, 2018: (a) around 16:46, July 31, 2018, in a “M” restaurant managed by the victim L on the sixth floor of Songpa-gu Seoul building E, Songpa-gu, Seoul; and (b) in fact, even if he was provided with food, he/she is obliged to pay the amount in spite of the absence of the intent or ability to pay the amount.
