피고인은 2014. 7. 26. 22:00경 창원시 마산합포구 진전면 양촌리에 있는 대정계곡 앞에서부터 같은 구 월영동에 있는 밤밭고개 앞 도로에 이르기까지 약 10km 구간에서 혈중알코올농도 0.129%의 술에 취한 상태로 B 프레지오 승합차를 운전하였다.
