[2] On December 11, 2015, the Defendant issued a summary order of three million won to be punished for fraud at the Seoul Eastern District Court on September 24, 2015; a summary order of two million won to be punished for fraud; a summary order of two million won in the same court on November 21, 2014; and a summary order of seven million won in the same court on April 26, 2013 to be punished for fraud; and a summary order of seven million won in the same court on June 28, 2007 to be sentenced on June 20, 2007 to be habitually punished by imprisonment with prison labor at the Seoul East Eastern District Court on November 22, 2006 to be habitually punished by imprisonment with prison labor at the same court on September 29, 2006; a person who has been sentenced to the said suspended execution on June 16, 205 to be punished by imprisonment with prison labor at each of the above Seoul District Court on June 26, 20015.

[Criminal facts]

1. On January 14, 2016, around 19:25, the Defendant was provided with alcohol and food equivalent to KRW 13,000,00, total market value of KRW 13,00,00, in the instant case, from the victim D (V) located in Jongno-gu Seoul Metropolitan Government, for the following reasons: (a) on the part of the Defendant: (b) around January 14, 201, the Defendant was provided with alcohol and food equivalent to KRW 6,00,00, total market value of KRW 13,00,000, in the instant case, from the victim who did not have any intent or ability to pay the drinking value, etc.; and (c) on the part of the victim D (V) who was placed in Jongno-gu Seoul Metropolitan Government.

Accordingly, the defendant was provided property by deceiving the victim habitually.

2. When the Defendant was requested from the victim D to pay the drinking value, etc. after drinking alcohol, etc. at the time, place, and place mentioned in the preceding paragraph, the Defendant, who interfered with his duties, received a request from the victim D for about 15 minutes, followed up 3 the tabler to the said place, and collected the misunderstanding, followed up the victim’s bath, such as “Cals,” and led the victim to other customers.
