The defendant was a resident of Dobong-gu Seoul Metropolitan Government who was in charge of the chairperson of the B Apartment Complex Election Commission, and the victim D was elected as the chairperson of the representative council of occupants of the above apartment, and was known to each other.

On July 2018, the Defendant publicizeds apartment chimney stack and made an explanation of the background that became self-management and made it possible to distribute it to residents late at night. However, the Defendant was willing to slander the victim on the ground that the victim who is in charge of the president of the council of occupants' representatives did not speak that he/she would have been able to do so to the executive department, and that he/she did not help it.

1. 피고인은 2018. 9. 13.경 및 2018. 9. 14.경 불상의 장소에서 B아파트단지 입대위 관련 모임인 ‘E’ F 단체 대화방에 “전날 수행비서 데리고 시원한 바람 쐬고 다음날 늘어지게 자다가, 그 이틀 동안 땀으로 뒤범벅되어 일한 동료들을 보았으면 얼굴이라도 가리고 입이라도 다물어야 하는 염치 있어야 하는 거 아닌가, D 주민 누가 언제 너에게 ‘수고했다’는 말 기대했지, D 주민 ~ 중략 ~ 8공주들과 G과 그 동대표들과 그렇게 할려고 했던 거니 그럼 그렇게 해 가서 같이 하라고, 같이 사이좋게 나눠먹으면서 주말이면 수행비서 끌고 바람 쐬러 가고.”라는 내용의 글을 게시하였다.

그러나 사실 피해자는 수행비서를 데리고 바람 쐬러 간 사실이 없음에도, 피고인은 위와 같이 공공연하게 거짓의 사실을 드러내어 피해자의 명예를 훼손하였다.
