2. The costs of lawsuit shall be borne by the Plaintiff.

A. The Plaintiff is an educational foundation that establishes and operates the Korea Institute of Counseling.

B. On July 14, 2009, the Defendant (the Minister of Education, Science and Technology changed the name from the Ministry of Education, Science and Technology to the change of organization) approved the Plaintiff’s establishment of the Korea Counseling University School (hereinafter “instant University”) under the following conditions of authorization and conditions of authorization.

1. Matters to be authorized;

(a) Purpose of establishment: The purpose of establishing counseling theories and practice necessary for the Korean society, responding actively to new counseling fields, and training able professionals with mature competences for human beings;

(b).

Name: Korean Counseling College Assistants;

(c) Kind of school: Graduate school universities under Article 30 of the Higher Education Act; and

(f) The term of school years: At least two years, and at least three years, respectively.

(h) Date of opening of school: March 1, 2010;

98 persons with a total number of 200 (188 master, 12 master and doctoral degree) (200 persons with a total number of 94 master and master’s degree) of 98 students in cultural and social circles, social and psychological counseling, psychological counseling, psychological counseling, and psychological majors, and four major for each recruitment unit and each recruitment unit with the fixed number of students in 2010 for each recruitment unit and the fixed number of students in completion recruitment units for each recruitment unit with the fixed number of students in completion of compilation of the fixed number of students;

2. Conditions for authorization;

A. By February 16, 2010, the current status of appointment of at least 1/2 of the full-time teachers (excluding concurrent positions and invited teachers as referred to in Article 6(4)) under Article 6 of the Regulations on the Establishment and Operation of Universities shall be submitted, and “satisf teachers” shall be secured annually according to the fixed number of students, but all of them shall be met before the completion of the organization (hereinafter “instant authorization terms”).

When operating universities, education-related Acts and subordinate statutes, such as the Higher Education Act, Private School Act, and regulations on the establishment of universities, shall be faithfully observed

When the above authorization conditions are not fulfilled or the application for authorization for the establishment of a university is found.
