피고인은 2014. 3. 26. 01:20경 성남시 중원구 C 소재 성남중원경찰서 D지구대에서 택시기사가 불친절하였으니 처벌을 해달라고 요구하여 경사 E로부터 절차를 안내받았음에도 출입문 앞에서 출입하는 경찰관들에게 "지구대 새끼들 전부 뇌물이나 처먹는다"라고 욕설을 하고 지구대 내부를 사진 촬영하고 그 이유를 묻는 피해자 경장 F에게 "쟤는 상황 파악도 못해. 너 좆나게 뺀질뺀질하게 생겼다. 30살밖에 안돼 보이는 새끼가 배는 좆나게 나와 가지고. 저 새끼는 그러고 있는 새끼야"라고 G과 여러 명의 경찰관이 있는 자리에서 말하여 공연히 피해자를 모욕하였다.
