1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
The plaintiff is a creditor against D, who is the husband, B asserts that since it is a surety who provided a security on January 15, 2015, the plaintiff bears the obligation against the plaintiff.
However, according to the plaintiff's assertion, B does not guarantee D's debt, but has guaranteed D's property, and since surety's property to secure another's property is not directly liable to creditors, the plaintiff's assertion is without merit.
(1) The plaintiff's claim is dismissed as it is without merit. It is so decided as per Disposition by the assent of all participating Justices on the bench.
