A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. Violation of the Road Traffic Act;
A. Although a person who does not register a driving school is prohibited from posting or advertising a trade name using a name similar to that of a driving school, etc., the Defendant made an advertisement using the word “C” website (D) and without registering a driving school from March 2015 to May 15, 2015, the Defendant advertised a non-registered driving school using the word “C”, “school driving training”, “one-class dancing training for the instructors of a friendly instructor,” “at the time and place of wanting,” “on-line training”, “on-line training application”, “on-road training course”, “private teaching institute”, and “voluntary instructor.”
B. Although a person who did not register a driving school is prohibited from conducting driving education outside the driving school for a fee, the Defendant employed E, F, G, H, I, etc. as an driving education instructor, and conspired with the above E, etc. to receive a certain fee when the Defendant directly provided driving education to the customers who called the above Internet site advertising or introduced E, etc. by introducing driving education to them.
On June 3, 2014, the Defendant: (a) provided driving education to the J requesting driving education without registering a driving school; (b) received KRW 220,000 from J; and (c) received compensation as stated in the attached Table of Crimes (A Onerous Driving List) from the Defendant, E, etc.
Accordingly, the Defendant conspiredd with E, etc. to conduct driving education without registering a driving school from May 14, 2014 to May 24, 2015.
2. Fraud;
A. At around 11:00 on May 12, 2014, I, the Defendant’s instructor, is owned by the Defendant against K (n, 20 years old), without registering a driving school.
