The defendant is the resident of Yongsan-gu Seoul Metropolitan Government B apartment (hereinafter referred to as the "the apartment of this case") and the victim C is the general director of the apartment of this case, and the victim D is the representative of the occupants of the apartment of this case.

The Defendant, while the representative meeting of the occupants of the instant apartment, paid KRW 23.1 million to the law firm E in the course of the lawsuit on a separate basis, was aware of the fact that the lawsuit was returned to the victims, which is a part of the litigation cost, and attempted to spread the false fact about the victims and interfere with the work of the representative meeting of occupants.

1. On July 2016, the Defendant made several remarks to the effect that “C and D share the amount of KRW 7 million out of the attorney’s fees of KRW 23.1 million to apartment residents F in the vicinity of the instant apartment No. 1 primary park No. 2016, Jul. 2016.”

However, the victims were merely returned to the account in the name of the representative meeting of the occupants of the instant apartment on September 21, 2016 and did not have any way to divide or embezzled the said money, due to the relationship in which the case was initiated in the process of filing a separate lawsuit in the name of the representative meeting of occupants.

Nevertheless, the defendant has damaged the honor of victims by openly pointing out false facts about victims.

2. From around 10:40 on August 10, 2016, the Defendant: (a) refers to the victim C, among five employees, etc. in the office of the representative council of occupants in the apartment management office of this case; (b) refers to the victim C; and (c) is the same as drinking with the desire of a person who is believed by the same human being.
