The prosecution of this case is dismissed.
Reasons
1. On September 25, 2015, around 18:00 on September 25, 2015, the Defendant committed assault against the victim C (the age of 65) by using a stick with the body part of Aluminium 2-3 times as a material for alkin, which was examined and filled by himself/herself, on the street above the Gangnam-gu Seoul Northern-ro 35-ro 23 Enmark.
2. Article 327 subparagraph 6 of the Criminal Procedure Act, Article 260 (3) and (1) of the Criminal Act (indicating of non-existence of punishment on October 27, 2016, which is after the institution of public prosecution);
