Defendant shall be punished by a fine of three million won.
If the defendant does not pay the above fine, KRW 100,000.
Punishment of the crime
The Defendant is a driver of E Co., Ltd. in Ulsan-gun, Ulsan-gun, and was the head of the Ulsan District Trade Union (hereinafter “victim”) of the Victim’s Korean Motor Vehicle Federation from March 1, 2016 to his/her police officer from January 1, 2018.
1. From March 1, 2016, the Defendant, as the president of the F branch of the Victim Association, was in charge of the operation of the F branch of the Victim Association, and received 11,400 won per member once every three months from the said E Co., Ltd. and received 11,400 won per member once every three months from the said E Co., Ltd. in preparation for an accident that may occur during the transportation of the members of the F branch of the Victim Association, and there was a duty to faithfully manage and keep the driver’s insurance proceeds created by receiving 11,40 won per member once every three months from the said E Co., Ltd.
Nevertheless, around March 31, 2016, at the F branch office of the Victim Association located in the above E Co., Ltd., the above driver's insurance money was deposited in violation of the above duties.
From the national bank account (Account Number H) in the name of G (FF trade union) to transfer to E corporation KRW 60,000,000 in mind, it was difficult to recover it.
As a result, the Defendant violated his duties, thereby obtaining the above 60,000,000 won proprietary benefits from E Co., Ltd., and causing damages to E Co., Ltd. equivalent to the above amount.
2. From March 1, 2016, the Defendant spent personal consumption by withdrawing KRW 500,000 from the above account at the office recorded in the preceding paragraph on October 24, 2017, and paying KRW 500,000 as a fine for the insult of the Defendant’s insult case, while receiving 1.5% of monthly salary for each member from the members of the F branch of the Victim’s Union at the expense of the Plaintiff’s association and having been in custody for the Victim’s Union at the expense of the Plaintiff’s association.
This is the defendant's property of the victim association.
