According to the statement in Gap evidence No. 1, the defendant prepared a document confirming that the balance of the goods due to the shipment of grain and food materials is KRW 61,464,680 on April 18, 2018, and the defendant paid the plaintiff the price for the goods as the price for the goods, and the fact that the defendant paid KRW 5 million on April 26, 2018, and KRW 3 million on May 21, 2018 to the plaintiff is the plaintiff.
According to the above facts, the defendant is obligated to pay to the plaintiff 53,464,680 won for the unpaid goods (=61,464,680 won - 5 million won - three million won) and to pay damages for delay calculated at each rate of 15% per annum as stipulated in the Civil Act, from May 2, 2018, the day following the day when the original copy of the payment order in this case was served to the plaintiff, until August 9, 2018, which is the day when the judgment was rendered, where it is reasonable for the defendant to dispute as to the existence or scope of the obligation.
