1. Basic facts
A. On March 6, 2007, B entered in the separate sheet (hereinafter “the instant real estate”) on March 6, 2007, with respect to ① the maximum debt amount of KRW 1,690,000,000, ② the debtor B and the mortgagee (hereinafter “new bank”) completed the procedures for establishing a mortgage with the new bank (hereinafter “new bank”).

On January 11, 2012, the new bank received from the Incheon District Court a voluntary decision to commence G auction on the instant real estate.
C. On February 27, 2012, the Defendant asserted in the voluntary auction court that “the Defendant has a claim for the price for remodeling construction works equivalent to KRW 739,00,000 against the Defendant’s B regarding the instant real estate,” and reported the right to the lien holder.

On June 15, 2012, the new bank transferred the secured debt of the instant right to collateral security, the instant right to collateral security, and other rights incidental thereto to the Plaintiff, and notified the transfer of the said right to collateral to B on June 18, 2012, and B received the notice of the said transfer of claim at that time.

2. The plaintiff's assertion that the defendant did not possess the secured claim of this case or did not possess the real estate of this case, there is no lien of this case.
3. Determination
가. 살피건대 을가 제1호증 내지 을가 제13호증의 각 기재 및 변론 전체의 취지에 의하면, 피고는 ① 2007. 1. 20.
