1. The Defendant shall pay to the Plaintiff KRW 23,095,682 as well as KRW 22,219,935 among them, from February 28, 2015 to the day of full payment.
Comprehensively taking account of the purport of the entire arguments in the evidence evidence Nos. 1 through 12, the Plaintiff loaned 26,00,000 won to the Defendant on May 19, 2014 at 22.4% per annum (it shall be 29% per annum) and agreed that the principal and interest of interest shall be paid in installments for 998,341 won per month for 36 months, and if delayed payment, the interest shall be forfeited, as of February 27, 2015. As of February 27, 2015, the Defendant’s loan principal amount shall be 22,219,935 won per annum, and the interest shall be 875,747 shall be acknowledged.
According to the above facts, the Defendant is obligated to pay to the Plaintiff delay damages at the rate of 29% per annum from February 28, 2015 to the date of full payment of the loan principal amounting to KRW 22,219,935 and the loan principal amounting to KRW 22,219,935.
Therefore, the plaintiff's claim of this case is reasonable, and it is so decided as per Disposition.
