피고인은 2016. 3. 18. 13:00경 동해시 D에 있는 E모텔 609호에 피해자와 함께 투숙하여 서로 합의 하에 1차 성관계를 가진 뒤 술을 마시던 중, 같은 날 18:00경 피해자가 피고인에게 ‘이제 그만 내연 관계를 끝내고 싶다, 헤어지자‘고 말하는 것에 화가 나 ’내가 뭘 잘못한 게 있다고 헤어지자고 하느냐‘면서 갑자기 주먹으로 피해자의 얼굴 및 옆구리 등 온 몸을 주먹으로 때리고, 피해자에게 ’침대 위로 올라가라, 옷을 벗어라‘고 하고, 피해자가 옷을 벗지 않자 재차 옆구리 등 몸 부위를 주먹으로 가격하여, 성관계를 거부할 시 계속하여 폭행할 것 같은 태도로 겁을 주고, 피해자를 때려 반항하지 못하게 한 뒤, 피해자 위에 올라 타 자신의 성기를 삽입하여 1회 강간하고, 이후 다시 피해자와 술을 마시던 중, 피해자가 ’헤어지자‘는 취지의 이야기를 다시 꺼낸 것에 화가 나, 재차 주먹으로 피해자의 얼굴 및 옆구리 등 온 몸을 주먹으로 때리고, 피해자에게 ’옷을 벗어라, 내가 이렇게 해야 너를 잊을 수 있을 것 같다‘고 말하는 등 성관계를 거부할 시 계속하여 폭행할 것 같은 태도로 겁을 주고, 피해자를 때려 반항하지 못하게 한 뒤, 피해자 위에 올라 타 자신의 성기를 다시 삽입하여 1회 강간하였다.
