1. The Defendant (Appointed Party) and the appointed parties are the Plaintiff:

(a) Attached Form 163 square meters out of 163 square meters of the miscellaneous land in Jeonnam-gun, Jeonnam-gun.

Reasons

1. Basic facts

A. The network D, E, F, and G shared 1/4 shares of 163 square meters (hereinafter “instant land”) in the miscellaneous land in Jeonnam-gun, Chungcheongnam-gun (hereinafter “Seoul-gun”), but thereafter, the Plaintiff acquired the shares of 1/4 of the said E by auction on February 23, 2017.

나. 이 사건 토지 중 별지 도면 표시 ㅂ, ㅅ, ㄴ¹, ㄷ¹, ㄹ¹, ㅂ을 차례로 연결한 선내 (가)부분, ㅁ, ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅁ을 차례로 연결한 선내 (나)부분, ㅊ, ㅋ, ㅌ, ㅍ, ㅎ, ㄱ¹, ㅈ, ㅊ을 차례로 연결한 선내 (다)부분, ㅌ, ㅁ¹, ㅂ¹, ㅍ, ㅌ을 차례로 연결한 선내 (라)부분, ㅋ¹, ㅅ¹, ㅇ¹, ㅈ¹, ㅊ¹, ㅋ¹을 차례로 연결한 선내 (마)부분에는 망 D 소유 건물의 부속물인 계단, 담장, 대문, 냉장창고 등 주문 제1의 가항 기재 각 지상물(이하 통틀어 ‘이 사건 지상물’이라 한다)이 존재하고, 위 토지는 위 건물의 부지로 이용되고 있다.

C. The network D died on March 10, 200 and succeeded to the defendant (Appointed Party) and the designated parties.

2. Even if a co-owner owns his/her share of assertion and judgment, the co-owner cannot exclusively possess, use, and benefit from, the co-owned property without consultation with other co-owners. Even if his/her share in the co-owners falls short of a majority, other co-owners may claim the delivery of the co-owned property as an act of preserving the co-owned property (see, e.g., Supreme Court en banc Decision 93Da9392, 93Da9408, Mar. 22, 1994). The above act of preserving the co-owned property includes the right to seek the removal of the above co-owned property from possession, such as the removal of the above ground building constructed on the co-owned property (see, e.g., Supreme Court Decision 2002Da57935, Nov. 13, 2003).
