성명 불상자는 국내 불특정 다수의 피해자들에게 전화를 하여 경찰관 등을 사칭하며 피해자로 하여금 현금을 인출하여 주거지 현관문 앞 등에 보관하게 하는 이른바 ‘ 보이스 피 싱’ 범죄 조직의 조직원이고, 피고인은 2020. 11. 초순경 성명 불상자와 위챗으로 연락하여 성명 불상 자가 지정하는 장소로 이동하여 피해자들이 놓아둔 현금을 가지고 가 그 금원을 위 성명 불상 자가 지정하는 계좌 등에 전달하고 그 대가로 수당을 받기로 공모하였다.

위와 같은 공모에 따라 성명 불상자는 2020. 11. 17. 12:00 경 피해자 B에게 전화를 걸어 ‘ 경찰관인데 누군가 할머니 돈을 노리고 있으니 빨리 통장에서 현금을 빼 집으로 가지고 와 검은색 비닐봉투에 현금을 넣어 집 현관문 앞에 놓아두면 아무도 모르니 안전할 것이다 ’라고 거짓말을 하여 이에 속은 피해자로 하여금 피해자의 계좌에 있던 현금 1,300만원을 인출하여 전 남 목포시 C에 있는 피해자의 주거지 현관문 앞에 놓아 두게 하고, 피고 인은 위 성명 불상 자로부터 위챗으로 ‘ 피해자의 주거지로 가 현금을 수거하라’ 는 연락을 받고 2020. 11. 17. 13:00 경 위 피해자의 주거지 앞에 이르러 피해자의 소유인 위 현금 1,300만원이 들어 있는 봉투를 가지고 가 절취하였다.
