The defendant is the representative D in Gangseo-gu Seoul Metropolitan Government, who ordinarily employs 41 full-time workers and operates the bread and the fruit wholesale business.

(a) When a worker dies or retires, the employer shall pay the wages, compensations, and all other money or valuables within 14 days after the cause for such payment occurred;

Nevertheless, the defendant did not pay 3,188,965 won in total, including 1,194,643 won of retirement allowance E of retired workers who worked in the above workplace, and 3,188,965 won in total, as shown in the list of crimes (excluding B) in attached crimes, within 14 days from the date of retirement without agreement on the extension of payment date between the parties.
