Purport of claim and appeal
The first instance court.
1. The reasoning of the court's explanation concerning this case is that "the whole purport of each entry and pleading in Eul evidence Nos. 1 through 9 and 11 (including each number in case of additional numbers)" among the grounds of the judgment of the court of first instance is "each entry in Eul No. 1 through 9, 11 through 19 (including each number in case of additional numbers), and the purport of the whole testimony and pleading of witness G of the court of first instance," and the reasoning of the judgment of the court of first instance is as stated in the part of the grounds of the judgment of the court of first instance, except for adding the following additional determination as to this case's safety defense at the court of first instance, it is identical to the entry in the part of the judgment of the court of first instance, and thus, it is cited in accordance with the main sentence
2. The portion to be determined additionally
A. The Plaintiff’s assertion only remains as the owner of the instant building, and the actual owner is G, and thus, the Plaintiff is not eligible to raise an objection against the Defendant’s request for distribution.
B. Determination 1) A person registered as an owner at the time of the registration of commencement of auction at the time of the registration of entry into the order to commence auction falls under an interested party in the auction procedure so long as the registration under his/her name has not been cancelled or transferred even if there is a separate owner, and thus, he/she has the right to raise an objection against the distribution schedule and thereafter has standing to sue to file a lawsuit of demurrer against distribution (see Supreme Court Decision 2014Da53790, Apr. 23, 2015).
3. In conclusion, the judgment of the court of first instance is legitimate, and the plaintiff's appeal is dismissed as it is without merit. It is so decided as per Disposition.
