피고인은 피해자 B(여, 29세)의 남편으로, 평소 피해자가 피고인의 성관계 요구를 들어주지 않는 점 등을 이유로 사이가 나빠져 2019. 1. 23.경부터 별거 중으로, 2019. 2. 1. 23:43경 “차에서 죽으려고 부탄가스를 5개를 틀고 잠들었어. 눈 깜빡했는데 아침이더라고”, 2019. 2. 1. 23:58경 “불 질러서 다 같이 죽어버릴까 나한테는 사랑하는 사람 죽일 용기도 배짱도 없어”, “동생 군대 인생 망쳐버릴까 이건 장모님이 고통 받지 당신은 아무런 문제가 안 되잖아”라는 메시지를 보내고, 2019. 2. 2. 21:41경 “이렇게 죽으면 저 세상 가도 너 때문에 한 맺혀서 죽어서도 니 한평생 쫓아다니면서 괴롭힐거야”라고 피해자에게 메시지를 보내는 등 피해자에게 수 차례 피해자를 원망하는 내용, 부탄가스를 피워 자살시도를 하였다는 내용의 카카오톡 메시지를 보냈다.

On February 3, 2019, around 10:35, the Defendant used butdane gas that combines the structure of the building C in Yangju-si and the apparatus that is dangerous to the residence of the victim (i.e., a well-known soil).
