1. The Plaintiff:
(a) Defendant A is the building listed in Section 1 of the attached list;
B. Defendant B shall set out in attached list No. 2.
1. Facts of recognition;
A. On November 26, 2018, the Plaintiff, as a project implementer of “C District Urban Development Project”, completed the registration of ownership transfer for a building listed in attached Table No. 1 (hereinafter “instant building No. 1”) located within the said project zone due to expropriation on November 13, 2018. On October 11, 2018, the Plaintiff completed the registration of ownership transfer for a building listed in attached Table No. 2 (hereinafter “instant building No. 2”) located within the said project zone due to sale on the same day.
B. On October 29, 2018, the Plaintiff entered into a compensation agreement with Defendant A on the obstacles and goodwill of the instant building No. 1 possessed by Defendant A as follows. Accordingly, on November 2, 2018, the Plaintiff paid Defendant A KRW 69,484,000 for losses.
2. Contract amount: 7,204,500 won, annual payments: 69,484,000 won, reserved amount: 7,720,500 won;
3. A refers to a seller in the contract to be incorporated into a zone C urban development project. In order to verify that an agreement has been reached pursuant to Article 16 of the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects between the seller and the buyer pursuant to Article 17 of the same Act, two copies of the contract shall be prepared and kept in one copy after signing and sealing the contract in order to verify that the following terms and conditions of the contract have been agreed upon pursuant to Article 17 of the same Act.
Article 1 (Claim, Payment, etc. of Contract Amount) (2) A seller shall submit to the buyer the documents required for the transfer of a right to land and obstacles, and the buyer shall pay the amount calculated by subtracting the reserved amount from the contract amount under Article 2 to the bank account in the name of the seller, except in extenuating circumstances, to the extent that it is deemed possible to transfer a right after the conclusion of this contract, and the reserved amount shall be paid after the removal of obstacles is completed.
Article 2 (Limited Matters, etc.) The seller shall enter into a contract with the goods under the contract after entering into the contract.
