Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

On July 14, 2017, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit, when selling a film ticket at the J film theater located in Mapo-gu Seoul Metropolitan Government, presented the G bank fitness card in the name of the damaged person as if he was the genuine right holder and presented it to employees under the name of the damaged person as if he was the true right holder, and received two film tickets in an amount equivalent to 36,500 won and two pop-up containers from the damaged person from the same day to 12:44 on the same day, and used the lost check card in the same manner.

On April 8, 2018, from around 18:00 to 22:25, the Defendant embezzled L credit cards lost by the victim K on the roads near the Hong Gan-ro 156 (Dong Dongdong) in Mapo-gu Seoul, Mapo-gu, and embezzled as he/she had the idea to have, without following necessary procedures, such as acquiring one copy of his/her L card, and returning it to the victim.
