1. The Defendant’s KRW 146,106,855 as well as the Plaintiff’s KRW 6% per annum from October 1, 2015 to May 16, 2016, and the following.
The Plaintiff supplied the goods, etc. of KRW 241,916,675 to the Defendant, who operates a mutual company called “B”, from April 1, 2014 to September 30, 2015.
The balance of the supply price that the Defendant did not pay to the Plaintiff is KRW 146,106,855.
[Grounds for recognition] No dispute exists. Gap evidence Nos. 1-3, and the defendant is obligated to pay to the plaintiff the balance of 146,106,855 won in the supply price, and to pay damages for delay calculated at each rate of 15% per annum under the Commercial Act from October 1, 2015 to May 16, 2016, which is the delivery date of the original copy of the payment order of this case, and from the next day to the date of full payment.
The plaintiff's claim is accepted.
