【Criminal Facts】
1. Even if the Defendant borrowed money from the victim B even if he did not have the intent or ability to complete the payment, the Defendant deceptioned the victim and acquired 500,000 won in total as follows.
On January 10, 2017, the Defendant presented a forged real estate lease contract to the victim at the place of residence of the victim of the Busan Dong-gu C, Busan, with the following: “I will pay for the loan of money due to the settlement of any other person; I will pay for the loan.” On January 10, 2017, the Defendant borrowed KRW 4 million after drawing up a false loan certificate.
B. On March 15, 2017, the Defendant lent money to the victim for the purpose of use in a horse race track at the same place, stating that it would be possible to repay the money to the victim, thereby borrowing KRW 1.5 million from the victim.
2. At the time of the preparation of a loan certificate by borrowing money from the victim, the Defendant forged one copy of the "real estate lease contract for the preceding year" as stated in the following: "One million won for the purpose of borrowing money from the victim; "One million won for the purpose of borrowing money from the victim;" "Me-gu in Busan; the address of the tenant; the resident registration number F; the tenant's telephone number G; H; the tenant's name; the tenant's address address D; the tenant's resident registration number I; the tenant's resident registration number J; and the tenant's name A; and the victim's name A forged one copy of the "real estate lease contract for the preceding year" as mentioned above.
