A. The Defendant thought that misunderstanding of facts would assist the Defendant in the saving of his name, and did not know that he was used for the commission of the phishing crime, and that he printed out the official document in relation to the exercise of a false official document, but did not know of what meaning it was a document because he did not think that it was a large amount of information and did not confirm the content.

B. The sentence imposed by the lower court (three years of imprisonment) is too unreasonable.

C. The lower court’s compensation order is excessive because the Defendant’s assertion on the compensation order is very economically difficult.

2. Determination:

A. 1) In full view of all the following circumstances acknowledged by evidence of each judgment of the court below which duly adopted and investigated the court below, the court below found the defendant guilty on the ground that even if the defendant was unable to know all the specific contents and methods of the whole crime during the course of committing the crime of Bosing and attempted fraud in this case, the defendant could have sufficiently recognized that he participated in the crime of Bosing and phishing in accordance with the combination of intention consecutively, under the mutual circumstance where he was able to fully recognize that his act was the process of committing the crime of Bosing and attempted fraud in this case, and where he could have sufficiently known the fact that his act was the process of committing the crime of Bosing and attempted fraud in this case, he would be able to recognize that he was not aware of the facts that his act was the process of committing the crime of Bosing and sphishing and at least at least 1 million won of contact with the defendant, and that he was able to contribute to the crime of Bosphing and 1 million won of contact with the defendant's name deposit.
