2. 피고인은 2013. 6. 6. 15:40 위 1항과 같은 장소인 홈플러스 상동점 1층 매장에서 위 매장 진열대에 진열되어 있던 피해자 C가 관리하는 시가 합계 총 75,350원 상당의 포켓터블바람막이 1개, 각종 베이글 총 4개, 종이컵 1줄, 홍삼카라멜 1개, 한입떡볶이 2봉, 아몬드쿠키 1개,남양초코에몽 2개, 우동그릇 1개, 아워홈 손수 듬북담북 3개, 단무지 2봉, 햅쌀밥 6입 1개, 은박매트 1개 총 12종의 물건을 카트에 실은 채 무인 자율계산대를 통과하여 가지고 가 이를 절취하였다.
