1. All appeals filed by the plaintiffs are dismissed.

2. The costs of appeal are assessed against the Plaintiffs.

The purport of the claim and appeal is the purport of the appeal.

Reasons

1. Facts of recognition;

A. On or before April 8, 1982, the Plaintiffs and the Intervenor joining the Defendant: (a) F is a single-story house of 39.39 square meters and a boiler room of 0.18 square meters (hereinafter “instant building”) on the ground of 231 square meters in Yeongdeungpo-gu Seoul Metropolitan Government G bank G bank 231 square meters, Yeongdeungpo-gu, without permission of the competent authority.

The Defendant newly built a new building. On April 9, 2006, the Plaintiffs, who were wife A and their children, jointly inherited them. 2) The Defendant’s Intervenor, including the site of the instant building, was authorized to establish an association by the head of Yeongdeungpo-gu Seoul Metropolitan Government (hereinafter “head of Yeongdeungpo-gu”) pursuant to Article 16 of the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”) on July 11, 2006, with the association established to implement an urban environment improvement project on the said land as its members of the aggregate of 506 parcel of land size of 506 square meters in Seoul, Yeongdeungpo-gu, Seoul, including the site of the instant building.

3) Article 19(1)1 of the Urban Improvement Act and the Articles of Incorporation of the Intervenor joining the Defendant (hereinafter “Articles of Incorporation”) are the co-owners of the instant building.

In such cases, the representative shall be designated as the representative member, and he/she shall prepare a written consent to the appointment of the representative member in attached Form and report it to the union.
