Reasons

1. Basic facts

A. 1 Status of the Parties C Co., Ltd. (hereinafter “C”).

) The company is the executor of the business of newly building and selling E apartment units, which are multi-family housing with a scale of 1,287 units on the ground of the Incheon Metropolitan City Free Economic Zone D block, and the F Co., Ltd. (hereinafter “F

(hereinafter referred to as the “G”) is the executor of the project that newly constructs and sells the E apartment (hereinafter referred to as the “instant apartment”) which is a multi-family housing with a scale of 1,680 households on the ground of Hable block of Incheon Metropolitan City (hereinafter referred to as the “instant apartment”) upon entering into a land development trust agreement with C and management-type land development trust agreement.

3) The plaintiffs concluded a sales contract with F, C, or G for the apartment of this case or acquired it from the first buyer (hereinafter the plaintiffs and F, C, or G). The sales contract between F, C, or G is "the sales contract of this case".

4) The Plaintiffs concluded a credit guarantee agreement with the Defendant to guarantee the payment of intermediate payment pursuant to the instant sales contract, and submitted a credit guarantee agreement with the Defendant.

B. 1) From around 2012 to 2012, the sales contract parties of this case including the Plaintiffs filed a lawsuit against F, C, and G on the basis of the cancellation or cancellation of the sales contract of this case. 2) The Plaintiffs did not delay the payment of interest on the intermediate payment loan, or did not file an application for the extension of the due date while the Plaintiffs brought a lawsuit, such as the claim for the refund of the sale price, etc.
