Punishment of the crime
Since 2002, the Defendant is a person who operates the “C”, a website for public relations of entertainment establishments.
On July 15, 2014, the Internet site was determined and announced as harmful media materials to juveniles by the Broadcasting and Communications Deliberation Committee.
1. Where the water of a media harmful to juveniles is the code, text, sound, or image information through telecommunications under the Telecommunications Business Act, a person who provides such code, text, sound, or image information shall put a mark indicating that it is harmful to juveniles with respect to the water of a media harmful to juveniles;
Nevertheless, since 2002, the Defendant operated the “C” website, which is a media harmful to juveniles, and was inspected by the female family division on three occasions on June 27, 2016, August 8, 2016, and October 11, 2016, but did not put a mark harmful to juveniles.
2. A person who intends to sell, lend, or distribute media products prescribed by Presidential Decree as harmful media products to juveniles, or provide them for viewing, watching, or using such media products shall verify the age and identity of the other party, and shall not sell, lend, or distribute to juveniles, or provide them for viewing, viewing, or using such media products;
Nevertheless, the Defendant operated the “C” website, which is a media harmful to juveniles, provided that, on June 27, 2016, the Defendant was inspected by the department of female families on three occasions on October 11, 2016, but provided that, without verifying the age and identity of the other party, information harmful to juveniles of “C” can be disclosed.
