The facts of the cause of the claim do not conflict between the parties or can be acknowledged in full view of the purport of the entire pleadings in Gap's evidence. Thus, the defendant is liable to pay to the plaintiff the amount of 49,641,812 won remaining after deducting the amount of 50,685,972 won paid by subrogation from the amount of 1,04,160 won and the amount of 32,908 won paid by subrogation, and damages for delay calculated at the rate of 12% per annum from November 10, 2014, which is the date of subrogation to the date of full payment.

If so, the plaintiff's claim is justified and accepted.
