The plaintiff's claim against the defendants is dismissed in entirety.
Litigation costs shall be borne by the plaintiff.
1. The Plaintiff shall commission the Defendants to write a broadcast theater (20 parts of the broadcast theater) under Article 1 (Commission of Writing of the broadcast theater).
The Defendants shall complete the writing of the text of the broadcast theater from June 1, 2016 to May 31, 2019 (three years) in accordance with the request for the original writing.
(2) Except in cases of force majeure, such as an accident or disease, the Defendants shall not interfere with the production of the Plaintiff’s program by suspending the presentation of a theater or delaying the submission deadline of a theater without the Plaintiff’s prior consent.
3. The Defendants may not write the theaters of another broadcasting company or other film production company at the time of completion of the writing of this contract or by the deadline for the submission of the theaters.
④ The Plaintiff may request an increase or decrease in the frequency of writing when changing the frequency of broadcasting programs, and shall be determined by mutual consultation at the time of request, and the Defendants shall accept the request to the maximum extent possible.
Article 2 (Payment and Settlement of Plaintiff Fees) (1) The Plaintiff shall pay the Defendants the Plaintiff fees upon the commission of the main body as follows:
(2) Where any change occurs in the content of broadcasting, etc. under Article 3 of this Agreement, the Plaintiff fees may be increased, decreased, and adjusted according to the changed details.
③ In the event that the Defendants failed to complete the frequency of agreement by the deadline for the submission of the text of agreement, the Plaintiff’s fee return or extension of writing shall be determined by mutual agreement between the Plaintiff and the Defendants.
(Provided, if the Defendants return to the number of unwritten statements, they return the unwritten statements to cash by the end of the following month of the deadline for the extension of writing, and the Plaintiff and the Defendants prepare a separate modified writing contract and enter into a contract for the extension of writing.) In this case, the changed contents shall be notified without delay to the Defendants, and the number of copies written in the theater, the deadline for submission of the theater, etc. may be changed through consultation between the Plaintiff and the Defendants.
