A defendant shall be punished by imprisonment for one year.
Of the facts charged in the instant case, the charge of fraud is acquitted. The judgment of the court below is not guilty.
Punishment of the crime
[Criminal Power] On August 8, 2012, the Defendant was sentenced to a suspended sentence of five years for a violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud) in the Suwon District Court of Suwon District, which became final and conclusive on August 17, 2012.
【Criminal Facts】
"2013 Highest 1582" Defendant brought a lawsuit against D, its husband, regarding the implementation of the procedure for filing an application for permission for a land transaction contract, and had the intention to submit forged certificates, receipts, etc. for the purpose of using them in the said lawsuit.
On December 7, 2005, the Defendant: (a) made a written statement stating that “A shall not perform the promise to pay the price in several times after entering into a contract with the owner E on ten parcels outside the F, and shall continue to delay payment until December 15, 2005; (b) if the contract is not performed even until December 15, 2005, he shall give up all the rights of the contract entered into with E, and shall attach his seal impression that he shall assume his responsibility for all civil and criminal responsibilities until G shares are held; (c) around August 3, 2006, the Defendant shall prepare a written statement stating that “A shall not perform the promise to pay the price in several times; (d) if a notary public located in Seongbuk-dong, Seongbuk-gu, Seoul Special Metropolitan City on June 21, 2006, he shall not perform the sale contract, and (e) shall not perform the sale contract in good faith, such as a written confirmation, and (e) shall not perform the sale price in 10 years and other 20 years of land.
