1. Deposit money deposited by the Busan District Court No. 9256 on October 26, 2012, the Dong-gu Busan Metropolitan City was KRW 91,65,100 and KRW 91,65,100.

Reasons

1. Facts of recognition;

A. On around 2006, Busan Metropolitan City Dong-gu established an implementation plan for an urban planning facility project to build a road in Busan Dong-gu C (hereinafter “instant land”), but changed the project to exclude the instant land from the land subject to incorporation due to the lack of the project cost due to excessive compensation for losses as a result of appraisal and assessment. On around 2009, an urban planning facility project to build a road on ten lots, such as Busan Dong-gu D, excluding the instant land, was implemented, and again, an urban planning facility project was implemented to build a road on the instant land and its daily site at around 2012.

B. On January 1, 1997 through August 24, 2004, the Plaintiff entered into a sub-lease contract with G on July 14, 201, the Plaintiff entered into a sub-lease contract with the Defendant’s mother as to the instant store with KRW 8 million, monthly rent 2 million, and the period of July 14, 2012 (hereinafter “sub-lease contract”). The Plaintiff anticipated the implementation of the urban planning facility project and the payment of compensation, and anticipated the implementation of the urban planning facility project to be made, and did not transfer the instant facility to G, as it is, that the Plaintiff was established with the Plaintiff, without any terms and conditions of the Government Corporation (G Fire Fighting Road).

C. On November 25, 201, the Plaintiff’s business registration under the name of the Defendant gave rise to the need to change the name of the business registration for the instant store, and brought to G with the owner of the instant store, H, lessee, the Defendant, the deposit amount of KRW 20 million, monthly rent of KRW 500,000, monthly rent of KRW 500,000, and the lease contract (hereinafter “lease contract with the owner”) for two years from November 25, 2011.
